Waste Disposal Edgware provides waste collection and disposal services for domestic and commercial customers within our designated service area, including Edgware and surrounding locations. The exact nature, frequency, and extent of the Services will be as agreed at the time of Booking and confirmed by us.
We reserve the right to refuse to provide Services where:
The Waste is not properly described or is misrepresented.
The Waste is hazardous or prohibited under law or under these Terms and Conditions.
Access to the collection point is unsafe, unlawful, or not reasonably practicable.
3.1 Making a Booking
Customers may request a Booking by telephone or other communication channels publicised by us. When you contact us, you must provide accurate information, including:
Your name or business name.
Contact details and collection address.
A clear description of the type, approximate quantity, and location of the Waste.
Any relevant access details, time restrictions, or parking constraints.
3.2 Acceptance of Booking
A Booking is only confirmed when we explicitly accept it and provide a date or time window for the Service, together with a price estimate or fixed quotation. We may require further details or photographs of the Waste to confirm the price and feasibility of the Service.
3.3 Changes to Bookings
If you wish to change the date, time, or scope of a Booking, you must contact us as soon as possible and in any event no later than 24 hours before the scheduled collection time. Changes are subject to availability, and we are not obliged to accommodate any requested changes. Any variation may result in an adjustment to the quoted price.
4.1 Pricing Basis
Prices for our Services are determined by factors including, but not limited to, the type of Waste, volume, weight, labour required, access conditions, and disposal costs. We will provide a price estimate or fixed price before carrying out the Service, based on the information you supply.
4.2 On-Site Reassessment
Where the actual Waste or site conditions differ significantly from the description provided at the time of Booking, we reserve the right to revise the price on-site before starting the job. If you do not accept the revised price, we may cancel the Service and no further obligation will arise, save for any applicable cancellation charges as described in these Terms and Conditions.
4.3 Payment Terms
Unless we agree otherwise in writing, payment is due in full on completion of the Service. We accept standard UK payment methods as communicated to you at the time of Booking.
For business Customers with agreed credit terms, invoices must be paid in full within the period specified on the invoice. We reserve the right to charge interest on late payments at the maximum rate permitted by law, accruing daily until payment is received in full.
4.4 Non-Payment
In the event of non-payment, we may take any lawful steps to recover the amounts due, including instructing debt collection agencies or pursuing legal action. You will be responsible for any reasonable costs we incur in recovering overdue sums.
5.1 Customer Cancellations
You may cancel a Booking without charge by giving us at least 24 hours notice before the scheduled collection time. Cancellations made with less than 24 hours notice may incur a cancellation fee, which will reflect the reasonable costs and losses we have incurred.
5.2 Our Right to Cancel or Reschedule
We may cancel or reschedule a Booking at any time for reasons including adverse weather conditions, vehicle breakdown, staff availability, safety concerns, or other circumstances beyond our reasonable control. Where possible, we will notify you as soon as practicable and offer an alternative appointment.
5.3 Access and Waiting Time
You are responsible for ensuring that we have clear, safe, and lawful access to the collection location at the agreed time. If we are unable to carry out the Service due to inadequate access, absence of an authorised person where necessary, or failure to provide parking arrangements where required, we may treat the visit as a missed appointment and charge a reasonable fee.
We reserve the right to charge for excessive waiting time caused by delays attributable to the Customer.
6.1 Accurate Description of Waste
You must provide a truthful and complete description of the Waste, including any items that may be hazardous, bulky, or unusually heavy. If we discover that the Waste differs from the description, we may adjust the price, refuse to take specific items, or cancel the Service.
6.2 Preparation of Waste
Unless agreed otherwise, you must ensure that the Waste is reasonably accessible and, where appropriate, bagged or contained to allow safe collection. You must remove any personal or confidential items that you do not wish to be disposed of.
6.3 Ownership and Authority
By providing Waste for collection, you confirm that you are the owner of the Waste or have proper authority from the owner to arrange its disposal. You also confirm that the Waste is not subject to any third-party claim, lien, or restriction.
7.1 Compliance with Law
Waste Disposal Edgware operates in accordance with applicable UK waste management and environmental legislation. We will collect, transport, and dispose of Waste using lawful and responsible methods, and we may use licensed facilities or third-party providers where appropriate.
7.2 Prohibited and Restricted Items
Certain types of Waste cannot be collected or may only be collected under specific conditions, including but not limited to:
Clinical or medical waste.
Asbestos or materials containing asbestos.
Chemicals, solvents, oils, or flammable substances.
Gas cylinders, pressurised containers, and similar items.
Explosives, ammunition, or any illegal materials.
If you present such items for collection without prior disclosure and our express agreement, we may refuse to handle them and may charge for any costs or losses incurred.
7.3 Documentation
Where required by law, we will issue appropriate documentation in relation to the transfer or disposal of Waste. You must retain any such documents provided to you for the period required by applicable regulations.
8.1 Timing
While we endeavour to carry out Services at the agreed time, all times are approximate and subject to traffic, weather, operational constraints, and other factors. Time is not of the essence in respect of our obligations, but we will use reasonable efforts to minimise delays.
8.2 Property and Site Conditions
You are responsible for ensuring that the collection area is reasonably clear and that any stairs, corridors, or access routes are suitable for the removal of the Waste. We are not responsible for minor scuffs, marks, or wear and tear that may reasonably arise from moving items, provided we exercise reasonable care and skill.
8.3 Refusal of Service on Safety Grounds
Our staff may decline to handle any item or enter any area that they reasonably consider unsafe, unsanitary, or unlawful. In such cases, we may treat the affected portion of the Service as cancelled and adjust the price accordingly.
9.1 Our Responsibility
We will provide the Services with reasonable care and skill. If we fail to do so, we may, at our discretion, re-perform the Service or offer a suitable price reduction. Our liability to you in respect of any loss or damage arising out of or in connection with the Services is subject to the limitations set out in this section.
9.2 Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any:
Indirect, consequential, or special loss or damage.
Loss of profit, revenue, business, or opportunity.
Loss arising from events or circumstances beyond our reasonable control.
Our total aggregate liability for all claims arising out of or in connection with any Service shall not exceed the total price paid or payable for that Service, unless mandatory law requires a higher limit.
9.3 Exclusions
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
9.4 Customer Indemnity
You agree to indemnify us against all claims, costs, damages, and expenses arising from your breach of these Terms and Conditions, your failure to comply with applicable waste regulations, or any inaccuracy in the information you provide about the Waste.
10.1 Complaints Procedure
If you are dissatisfied with any aspect of our Services, you should contact us as soon as reasonably practicable, providing full details of your concern. We will investigate the matter and, where appropriate, offer a remedy such as rectification, re-performance, or a partial refund.
10.2 Time Limits
To allow us to address any issues effectively, you should notify us of any complaint within 7 days of the relevant Service. We may decline to consider complaints raised outside this timeframe unless there is a clear and justifiable reason for the delay.
We will collect and use personal data relating to Customers for the purposes of managing Bookings, providing Services, processing payments, and complying with legal obligations. We will handle such data in accordance with applicable UK data protection laws. By using our Services, you consent to the processing of your personal information for these purposes. We will not sell your personal data to third parties, and we will only share it where necessary to provide the Services, manage our business, or comply with the law.
We may update or amend these Terms and Conditions from time to time to reflect legal, regulatory, or operational changes. The version in force at the time of your Booking will apply to that Service. Any updated version will be made available on request, and continued use of our Services after changes take effect will constitute acceptance of the revised Terms and Conditions.
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision will be severed from the remaining provisions, which will continue to be valid and enforceable to the fullest extent permitted by law.
These Terms and Conditions, together with any written quotation or Booking confirmation, constitute the entire agreement between you and Waste Disposal Edgware in relation to the Services. You acknowledge that you have not relied on any representation or statement not expressly set out in these documents.
These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Waste Disposal Edgware.
